This Policy applies to personal data processed in connection with TLHP's website, contributions, donations, purchases, and communications. TLHP processes personal data on lawful bases including consent, contract performance, legitimate interests, and legal obligations under Malaysian law.

Legal framework: TLHP complies with the Personal Data Protection Act 2010 (Act 709) and relevant amendments (including the Personal Data Protection (Amendment) Act 2024), which regulate collection, use, disclosure, retention, security, and cross-border transfers of personal data in commercial contexts.

2. Categories of Personal Data Collected

  • Identity & account data: name, email, username, password, profile photo.
  • Contact & transaction data: postal address, phone, billing, donation/purchase records.
  • Contribution content: oral histories, recordings, transcripts, photos, biographical details and metadata (public or restricted per contributor choice).
  • Technical & usage data: IP address, device/browser, cookies, analytics.
  • Communications: support messages, consent records.

3. Purposes of Processing

We use personal data to: operate the Site and accounts; preserve, catalogue and publish contributions; process shop orders; communicate service messages and marketing (with opt-out); improve security and analytics; and comply with legal obligations. Processing sensitive or special-category data will occur only with explicit consent and special safeguards.

4. Sharing, Transfers and Service Providers

  • Service providers (hosting, payment processors, email, logistics) process data on TLHP's instructions.
  • Research partners or museums may access contributions when you consent or when content is designated public.
  • Legal disclosures: TLHP will disclose data to comply with lawful requests.
  • Cross-border transfers are protected by contractual safeguards and PDPA requirements.

5. Retention, Security and Your Rights

  • Retention: Data retained only as necessary for stated purposes, legal compliance, or archival preservation of historical contributions; deletion requests will be honoured unless retention is required by law or to preserve the historical record.
  • Security: Reasonable technical and organisational measures are in place; breaches will be handled per PDPA notification rules.

6. Contributor Licensing and Public Access

By submitting content you grant TLHP a worldwide, royalty-free, perpetual license to host, reproduce, adapt and display contributions for educational, research, archival and promotional purposes; restricted-access requests should be made before submission.
